All that tract or parcel of land lying and being in the 1169th G.M. District of Glascock County, containing 9.66 Acres and designated as Tract No. 2 according to a plat by Herman May, Surveyor, dated August 29, 1966, said plat being recorded in Deed Book 3T, Page 131, Clerk of Superior Court of Glascock County. Tract Two is the same property conveyed by Quitclaim Deed dated December 24, 1966 from Mrs. Cluese Hadden, Mrs. Gennettie Thigpen and Mrs. Vera Essie Thigpen Hadden to Mrs. Okla Williams and being recorded at Deed Book 3D, Pages 60-61, of aforesaid records. Tract Three:
All that tract or parcel of land lying and being in the 1169th G.M. District of Glascock County, containing 31.3 Acres, more or less, bounded now or formerly as follows: on the North by lands of Continental Can Company; East by waters of Joe’s Creek; South by other lands of A. C. Thigpen; and West by lands of Homer Dixon. Said lands being fully described in plat prepared by D. J. May, County Surveyor, on December 2, 1936. Said plat being recorded at Deed Book TT, Page 244. Tract Three is the same property conveyed by Warranty Deed dated July 28, 1962 from A. C. Thigpen to Mrs. Okla T. Williams and being recorded at Deed Book 44, Page 287, of aforesaid records.

Said property is conveyed subject to any and all easements and restrictions of record.

Tracts One through Three are the same properties devised to James A. Williams by the Last Will and Testament of Okla T. Williams by virtue of the probate proceedings filed for record in the Office of the Probate Court of Aiken County, South Carolina. A certified copy of the probate proceedings and Last Will and Testament of Okla T. Williams are filed for record in the Office of the Clerk of Superior Court of Glascock County, Georgia in Deed Book 4J, at Pages 674 and 679. Item III of said Will devised the above-described property to James A. Williams.

The above-described property is also the same property identified as Parcel No. 1 within that Deed of Distribution dated August 28, 2002, from Naomi R. Williams, as Personal Representative of Estate of James A. William to Mark A. Williams and recorded in the Office of the Clerk of Superior Court of Glascock County, Georgia in Deed Book 101, at Pages 473-475. A certified copy of the Last Will and Testament of James A. Williams and the probate proceedings from the Probate Court of Aiken county, South Carolina being filed in the Office of the Clerk of Superior Court of Glascock County, Georgia in Deed Book 111, at Pages 272-292.

The above described property is all of that property identified in the Office of the Tax Assessor of Glascock County, Georgia as Tax Map 13 Parcel 17. This also being the same property described in Warranty Deed dated December 7, 2006, recorded in Deed Book 113, Page 306, Clerk’s Office, Glascock Superior Court.

This herein Deed to Secured Debt is subject to the Security Deed from Kent Ray Road Investors, LLC to Bank of Morgan County filed contemporaneously herewith.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non payment of the installments of said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney’s fees.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is Deon Walker, as Trustee of the 3-Malachi-10 Trust, or a tenant or tenants, and said property is more commonly known as 90.62 acres, Kent Ray Road, Glascock County, Georgia.

Box 219 Wadley, GA 30477 (478) 252-1116 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS On or about January 30, 2012, the above named City will request the Georgia Department of Community Affairs (DCA) to release Federal funds under Title I of the Housing and Community Development Act of 1974, as amended, for the following project: Wadley Sewerage System Improvements 2011 CDBG: The proposed Target Area includes a portion of N. Martin Luther King Jr. Blvd. (A.K.A. Donovan Street) just south of Calhoun Street to Butts Street, Butts Street from N. Martin Luther King Jr. Blvd. to Hudson Street, Lincoln Avenue Extension and Lincoln Extension. The proposed sewer system improvements shows include rehabilitating the existing vitrified clay pipes by slip-lining with approximately 3,963 linear feet of 8-inch and 10-inch cured-in-place pipe liner. Other improvements will consist of cutting out protruding services in order to rehabilitate the pipes, replacing 56 existing clay house services with new PVC services, rehabbing 21 manholes and installing 1 new manhole to directly serve the customers within the target area. FINDING OF NO SIGNIFICANT IMPACT (FONSI) It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and, accordingly, the above named City has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190). The reasons for such decision not to prepare such Statement are as follows: Upon review, it has been determined that this project as proposed meets the requirements of all applicable statutes and is in compliance with all applicable regulations. It has been determined that this project will not have a significant adverse environmental impact on the human environment. An Environmental Review Record regarding the proposed project has been made by the above named City which documents the environmental review of the project and more fully sets forth the reasons why such Statement is not required. This Environmental Record is on file at the Wadley City Hall, 21 N. Main Street in Wadley, Georgia 30477. The phone number is (478) 252-1116. It is available for public examination and copying upon request. No further environmental review of such project is proposed to be conducted prior to the request for release of Federal funds. PUBLIC COMMENTS ON FONSI All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the City. Such written comments should be received at 21 N. Main Street in Wadley, Georgia 30477 on or before January 27, 2012. All such comments so received will be considered and the City will not request the release of Federal funds or take any administrative action on the proposed project prior to the date specified in the preceding sentence. NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (NOI/RROF) At least one day after the termination of the public comment period for the FONSI but not before comments on the FONSI have been considered and resolved, the city of Wadley will submit a Request for Release of Funds (RROF) and Certification to DCA. By so doing, the City will ask DCA to allow it to commit funds to this project certifying that (1) it has performed the environmental review prescribed by HUD regulations ("Environmental Review Procedures for Title I Community Development Block Grant Program" - 24 CFR Part 58), and (2) the Certifying Officer, Herman Baker, Mayor, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review or resulting decision-making and action. The legal effect of the certification is that by approving it, DCA will have satisfied its responsibilities under the National Environment Act, thus allowing the city of Wadley to commit Community Development Block Grant funds to this project. OBJECTION TO RELEASE OF FUNDS DCA will accept objection to this approval of the release of funds and the certification only if it is on one of the following bases: a) that the certification was not in fact executed by the Certifying Officer; or b) that applicant's Environmental Review Record for the project indicated omission of a required decision, finding, or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to DCA at CDBG Section, 60 Executive Park South, Atlanta, Georgia 30329-2231.
