DELINQUENT PROPERTY TAX SALE
Under and by virtue of certain tax Fi Fa’s issued by the City Administrator of Wrens, Jefferson County, Georgia, in favor of the State of Georgia and County of Jefferson, and the City of Wrens against the following named persons and the property as described next to their respective name(s). There will be sold for cash or certified funds at public outcry, before the Courthouse door in the city of Louisville, Jefferson County, Georgia, between the legal hours of sale, on the first Tuesday in June, 2011, the same being June 7, 2011, and continuing on Wednesday, June, 8, 2011, if necessary between the legal hours of sale, 10:00 AM and 4:00 PM. The below listed and described properties, or as much thereof as will satisfy the State and County tax execution on the respective individual and property. The property (ies) hereinafter described have been levied on as the property of the persons whose names immediately precede the property description. Each of the respective parcels of property are located in Jefferson County, State of Georgia. Said property is the same as that conveyed by a Warranty Deed dated September 1, 2006, from Jones Central, LLC to Clive Spencer, which is recorded in the Office of Clerk, Jefferson Superior Court in Deed Book 408, pages 260-262.
WHEREAS, said Deed to Secure Debt was executed to secure a Note of even date therewith, in the original amount of $17,700.00, with interest thereon as set forth therein, together with all other indebtedness of the borrower to the lender then due or that might thereafter become due, or thereafter become contracted, which was or would be evidenced by a note or notes, all as shown by said Deed to Secure Debt recorded in the Office of Clerk, Jefferson County Superior Court, in Deed Book 408, Pages 263-266.
WHEREAS, the debt secured by said Security Deed has been and is hereby declared due, because of among other possible events of default failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed.
WHEREAS, pursuant to O.C.G.A.§ 44-14-162.2, the name, address and telephone number of the individual or entity with full authority to negotiate, amend, and modify all terms of the Deed to Secure Debt is Jones Central, LLC, 4108 Arkwright Road, Macon, GA 31412 (478) 256-4321.
NOW THEREFORE according to the original terms of said Deed to Secure Debt and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash, the property described in said Deed to Secure Debt from Clive Spencer to Jones Central, LLC, after proper advertisement on the first Tuesday in June, 2011, between legal hours of sale before the Courthouse door in City of Louisville, Jefferson County, Georgia.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Proceeds from said sale will be used first, to pay the cost and expense of said sale; second, to pay the balance due on the indebtedness mentioned above from Clive Spencer to Jones Central, LLC, and third, to pay the surplus, if any, to the person or persons legally entitled thereto. The undersigned will execute a deed to the purchaser as authorized by the aforesaid Deed to Secure Debt.
To the best knowledge and belief of the undersigned, the party in possession of the property is Clive Spencer or a tenant or tenants and said property is more commonly known as Lot 10, Arbor Wood Subdivision, 76th G. M. District of Jefferson County, Georgia.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed, including but not limited to a determination that the loan was not reinstated prior to the foreclosure sale.
