On May 9, 2008, Michael S. Irby and Stephanie D. Irby executed a Deed to Secure Debt With Power of Sale to First Citizens Bank and Trust Company, Inc. securing a note of even date for Five Hundred Fifty-Nine Eight Hundred Ten and 64/100 Dollars ($559,810.64), said security deed being recorded in Deed Book 441, Pages 99-106, Jefferson County Records. Said security deed conveyed the property hereinafter described. Said property is conveyed subject to that certain Easement agreement, dated May 3, 2001 from Jay C. Bullock to Reynolds Metal Company, recorded in Deed Book 294, page 111, Jefferson County Records. Said property is conveyed subject to that certain Easement dated March 31, 1998, in favor of Jefferson EMC and recorded in Deed Book 244, Page 362, Jefferson County Records. Said property is conveyed subject to that certain Easement dated July 1, 1996, in favor of Jefferson EMC and recorded in Deed Book 228, page 175, Jefferson County Records. Said property is further conveyed subject to that certain Mineral Lease Agreement, dated August 15, 1967, and being recorded in the Office of the Clerk of Superior Court of Jefferson County, Georgia, in Deed Book 75, at page 476. Grantor herein also conveys herewith all right, title and interest in and to proceeds and all rights to Mineral Lease from Broadus Davis, as Lessor and Sherman and Hemstreet, Inc., as Lessee as referred to in that Memorandum of Agreement, dated August 15, 1962 and being recorded in Deed Book 75, at page 476, Jefferson County Records. Also: All that tract or parcel of land, together with the dwelling house and all other improvements thereon, situate, lying and being in the 76th GMD, Jefferson County, Georgia, containing 3.55 acres, more or less, and being as appears on plat of survey by Johnny E. Miller, Surveyor, dated April 9, 2001, and recorded in Deed Book 291, at Page 216, Jefferson County, Georgia Records. Reference is made to said recorded plat for a fuller and more particular description of said 3.55-acre tract, and said 30-foot access road. The above-described property is a portion of that 61.9 acre tract which is described in Warranty Deed from Broadus Davis to Jay Isaac (now known as Jay C. Bullock) dated February 25, 1994 and recorded in Deed Book 213, at Page 304, Jefferson County Records. Also included in this conveyance is a non-exclusive easement for the purpose of ingress and egress from the above-described 3.55 acre tract to Georgia Highway 88, over and across the 30-foot access road which is shown on the above described plat. Reference is made to that certain Easement Agreement dated April 24, 2001 by and between Terry G. Phillips and Mary A. Phillips and Jay C. Bullock recorded in the Office of the Clerk of Superior Court of Jefferson County, Georgia, in Deed Book 291, at pages 217-218. This conveyance is also made subject to the rights of adjoining landowners to use the easement identified as the 30-foot access easement/road which is shown on the above-described recorded plat. This instrument establishes a perpetual or indefinite security interest in the above described property as authorized by OCGA 44-14-80(a), as amended. If all or any part of the property or any interest therein is sold, leased, or otherwise transferred by deed, land sales contract or any other means including the execution or enforcement of any lien, security interest or other right whether subordinate, superior or equal to this Security Deed without Grantee’s prior written consent, Grantee may, at Grantee’s option, declare all sums secured by this Security Deed to be immediately due and payable. The debt secured by said security deed and note has been and is hereby declared due and payable because of default for non payment as required by the note and security deed. The debt having been declared due and payable and remaining unpaid, and the terms in the note and security deed remaining in default, this sale will be made for the purpose of paying the principal, accrued interest and attorney’s fees pursuant to the note and security deed, plus all expenses of this sale. Said property will be sold as the property of Michael S. Irby and Stephanie D. Irby and subject to outstanding ad valorem taxes and/or easements and/or restrictive covenants appearing of record, if any. The undersigned will comply with Georgia law, O.C.G.A. Section 44-14-162.2, prior to conducting the sale. To the best knowledge and belief of the undersigned, equitable title to said property is now held by Michael S. Irby and Stephanie D. Irby.
