ORDER OF THE JUDGE OF THE PROBATE COURT OF GLASCOCK COUNTY TO REGULATE AND PROVIDE FOR THE CALLING OF AN ELECTION TO DETERMINE THE CONTINUATION OF A ONE PERCENT SALES AND USE TAX AUTHORIZED BY ARTICLE 3 OF CHAPTER 8 OF TITLE 48 OF THE OFFICIAL CODE OF GEORGIA ANNOTATED; AND FOR OTHER PURPOSES: WHEREAS, the Board of Education of Glascock County (the "Board of Education") has furnished the Judge of the Probate Court of Glascock County, as Election Superintendent (the "Election Superintendent"), with a certified copy of its resolution adopted on June 18, 2010 (the "School District Resolution") calling an election pursuant to Sections 48-8-140, et seq. and 48-8-111, et seq., of the Official Code of Georgia Annotated, as amended, to determine whether a one percent sales and use tax as authorized by Article 3 of Chapter 8 of Title 48 of the Official Code of Georgia Annotated shall be continued for the purposes set forth in the School District Resolution, and has requested that the Election Superintendent join the Board of Education in the call of the election for such questions on November 2, 2010; and NOW, THEREFORE, BE IT ORDERED that there be and there is hereby called to be held in all the voting precincts in Glascock County School District (which embraces all of Glascock County) on the 2nd day of November, 2010, an election by the qualified voters of said School District to determine whether a one percent sales and use tax as authorized by Article 3 of Chapter 8 of Title 48 of the Official Code of Georgia Annotated shall be continued for the purpose of raising not more than $2,000,000 of net proceeds by said tax, which shall go to the School District for the purpose of (i) adding to, renovating, repairing, improving and demolishing, furnishing and equipping existing school buildings and other buildings and facilities useful and desirable in connection therewith, including, but not limited to, agricultural and band buildings, additional classrooms and physical education/athletic facilities; (ii) acquiring technology improvements, including safety and security improvements and computer technology; (iii) acquiring new school equipment, including new buses and maintenance vehicles; (iv) acquiring, constructing and equipping new school buildings and facilities useful and desirable in connection therewith, including athletic/physical education facilities and transportation and maintenance facilities; (v) acquiring any necessary or desirable property, both real and personal, including textbooks and band instruments, the maximum amount of the projects to be paid with sales and use tax proceeds will be $2,000,000. BE IT FURTHER ORDERED that such election be conducted pursuant to the applicable laws of the State of Georgia, that managers and election officials for all voting precincts be appointed and that election returns be consolidated in the presence of the Election Superintendent and that the result be declared, all as is provided by law.
