CONCURRECT NOTICE TO PUBLIC OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT AND NOTICE TO PUBLIC OF REQUEST FOR RELEASE OF FUNDS Date of Publication: July 15, 2010 City of Wrens 401 Broad Street Wrens, Georgia 30833 (706) 547-3000 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: On or about August 2, 2010, the above named city will request the Georgia Department of Community Affairs (DCA) to release Federal funds under Title I of the Housing and Community Development Act of 1974, as amended, and the Georgia CDBG Program Regulation of 1982, as amended, for the following project: Project Title: City of Wrens 2010 CDBG Sewer Improvements/ CDBG (#09p-x-081-2-5136) Project Activities: P-03J-02-Sewer Improvements T-03J-02-Engineering Activities A-21A-00-Administration Activities Project Location: The 2010 CDBG City of Wrens Sewer Improvement Target Area locations include Denny Road, Allie Street, Holly Road, Oak Street, Kings Mill Road, and Stephens Street. Project Description: Funding ($500,000) from this grant will improve the sewer facilities for the specified locations within the City of Wrens. Specifically, the proposed project will correct broken and collapsing sewer pipes that are causing backups and unsanitary conditions. The Engineer has proposed dig-and-replace construction techniques in order to provide a cost effective solution to the sewer problems. Also, the project plans to refurbish the Stephens Street Sewage Pumping Station instead of the Oak Street Station. This would require the construction of an additional 822 linear feet of sewer to divert all sewage top the Stephens Street Station and an additional 820 linear feet of the of forcemain to connect the Stephens Street Station to the Oak Street forcemain. To pay for these additions, a portion of sewer with no customers connected will be abandoned instead of being rehabilitated. As all the residents within the target area will be connected to rehabilitated sewers served by a refurbished pumping station, all the project objectives will be met and the beneficiaries will not change. There are 32 homes, 172 residents in the proposed Target Area, 152 (88%) are low to moderate income residents. FINDING OF NO SIGNIFICANT IMPACT (FONSI) It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and, accordingly, the above named city has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190). The reasons for such decision not to prepare such Statement are as follows: Upon review, it has been determined that this project as proposed meets the requirements of all applicable statutes and is in compliance with all applicable regulations. It has been determined that this project will not have a significant adverse environmental impact on the human environment. An Environmental Review Record respecting the proposed project has been made by the above named city which documents the environmental review of the project and more fully sets forth the reasons why such Statement is not required. This Environmental Record is on file at the City of Wrens Municipal Building at 401 Broad Street. It is available for public examination and copying upon request between the hours of 8:00 a.m. and 5:00 p.m. No further environmental review of such project is proposed to be conducted prior to the request for release of Federal funds. PUBLIC COMMENTS ON FONSI All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the city. Such written comments should be received at P.O. Box 125, Wrens, Georgia 30833 on or before July 30, 2010. All such comments so received will be considered and the city will not request the release of Federal funds or take any administrative action on the proposed project prior to the date specified in the preceding sentence. NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (NOI/RROF) At least one day after the termination of the public comment period for the FONSI but not before comments on the FONSI have been considered and resolved, the City of Wrens will submit a Request for Release of Funds (RROF) and Certification to DCA. By so doing, the City will ask DCA to allow it to commit funds to this project certifying that (1) it has performed the environmental review prescribed by HUD regulations ("Environmental Review Procedures for Title I Community Development Block Grant Program" - 24 CFR Part 58 and "HUD Regulations" - 24 CFR Part 135), and (2) the Certifying Officer, Mayor Lester Haddon, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review or resulting decision-making and action. The legal effect of the certification is that by approving it, DCA will have satisfied its responsibilities under the National Environment Act, thus allowing the City of Wrens to commit Community Development Block Grant funds to this project. OBJECTION TO RELEASE OF FUNDS DCA will accept objection to this approval of the release of funds and the certification only if it is on one of the following bases: a) that the certification was not in fact executed by the Certifying Officer; or b) that applicant's Environmental Review Record for the project indicated omission of a required decision, finding, or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedures set forth in (24 CFR Part 58) and (24 CFR Part 135); and may be addressed to DCA at CDBG Section, 60 Executive Park South, Atlanta, Georgia 30329-2231.
