NOTICE OF PETITION FOR CONDEMNATION AND SPECIAL MASTER HEARING
GEORGIA, JEFFERSON COUNTY
Take notice that, pursuant to the Petition In Rem For Condemnation of Rights-of-Way and Easements Before Special Master filed by Elba Express Company, LLC on November 11, 2008, Case No. 08CV00602 and pursuant to the Official Code of Georgia Annotated, Title 22, Chapter 2, Article 2, the Superior Court of Jefferson County has appointed J. Chadwick Hammond as Special Master to determine the amount of just compensation to be paid to condemnees. The Special Master will hold a hearing in this matter at 1:00 o’clock p.m. on Monday, March 9, 2009, in the Jefferson County Courthouse. The description of the affected property and the description of the rights sought to be condemned are set forth in Exhibit A.

Description of Interest Sought to be Condemned: A perpetual right-of-way easement 20 feet in width on, over, across and through that tract of land lying and being in the 77th and 81st G.M. District, Jefferson County, Georgia, said right-of-way easement is more particularly described as being situated 20 feet left of the following described line as depicted on Elba Express Drawing No. EX-GA-ELBA-1-040-CLP-001, to wit:

To locate the point of beginning commence at an iron pipe found on the south boundary of said property now or formerly owned by W.D. Jordan Estate, having a UTM Zone 17 coordinate of (N 12055644.24, E 1230957.11); thence N83º53’38”E on the south boundary of said property a distance of 157.55 feet to the point of beginning, said point lying on the south boundary of an existing Southern Natural Gas Company right-of-way; then N46º18’46”W on said right-of-way a distance of 1799.18 feet to the point of ending, said perpetual right-of-way containing 0.83 acres.
Temporary Right-of-Way Work Space No. 1:
Also for the purpose and duration of the initial construction and installation of the proposed pipeline, a temporary right-of-way and work space lying 70 feet south of and adjacent to perpetual right-of-way easement described above as depicted on Elba Express Drawing No. EX-GA-ELBA-1-040-CLP-001 and containing 2.89 acres.
